Terms and Conditions for Use of SRT Account

These Terms and Conditions (“Terms”) govern your access to and use of LudarisTech’s digital services, including the Slope Reading Trainer (SRT) platform, applications, and associated products.
By registering for and using an SRT account, you agree to these Terms. Please read them carefully.

1. Privacy and Data Protection

1.1 Your privacy is very important to us. LudarisTech follows and complies with Regulation (EU) 2016/679 (the General Data Protection Regulation – GDPR).

1.2 Please refer to our Privacy Notice for detailed information about how we collect, use, and protect your personal data, and about your rights under applicable data protection laws.

2. Cookies

2.1 We use cookies and similar technologies to enhance your user experience. Please refer to our Cookie Policy for more information about the cookies used by LudarisTech and how to manage your preferences.

3. Safety and Security

3.1 We make every effort to keep your SRT account secure. You agree not to:

• Upload viruses or malicious code.

• Solicit login credentials or access another user’s account.

• Use your account for unlawful, misleading, or harmful purposes.

• Facilitate or encourage any violations of these Terms.

4. Registration and Account Security

4.1 By creating and maintaining an account, you agree to:

• Provide accurate and truthful information and not create an account for anyone other than yourself without permission.

• Keep your contact information up to date.

• Keep your password confidential and not share access with others.

• Avoid transferring or selling your account to another person or entity.

5. Protecting Other People’s Rights

5.1 We respect the rights of others and expect you to do the same.
If you collect data from other players, you must:

• Obtain their consent before data collection.

• Make it clear that you—not LudarisTech—are collecting their data.

• Provide them with a privacy notice describing your data use.

You may not infringe intellectual property rights or use LudarisTech trademarks, copyrights, or confusingly similar marks without prior written consent. You may not send unsolicited messages to non-users.

6. Software and Updates

6.1 If you download or use our software (including mobile apps or plug-ins), you agree that periodic updates or upgrades may be automatically installed to improve performance and functionality.

6.2 You agree not to modify, reverse engineer, decompile, or extract source code from any LudarisTech software unless expressly permitted by applicable law or written permission from LudarisTech.

7. Promotional Communications

7.1 With your explicit consent, we may send promotional materials, updates, or offers related to golf products and services via email, SMS, or in-app messages.
7.2 You may withdraw or adjust your consent at any time through your account settings.

8. Use of SRT Account

8.1 Each account is personal and may be used only by the registered member. You are solely responsible for maintaining password confidentiality and for all activities under your account.

8.2 Only registered users may access SRT accounts. You may not share protected content or provide third parties with unauthorized access.

8.3 Any misuse of your account may result in termination or suspension. LudarisTech reserves the right to remove content or terminate accounts at its sole discretion.

8.4 While LudarisTech strives for accuracy, we do not guarantee that all website content is error-free. We reserve the right to modify website content at any time.

8.5 LudarisTech may revise these Terms or the website at any time without notice. Continued use constitutes acceptance of the updated Terms.

8.6 All intellectual property rights, including copyright, design, and trademark rights in the Slope Reading Trainer and related materials, are owned by LudarisTech GmbH & Co. KG.

8.7 If you provide your SRT device or account access to others (e.g. students, event participants), you must inform them of LudarisTech’s Privacy Notice and obtain their consent before data collection.

8.8 If participants use the Tournament Mode or any test through LudarisTech, you must notify them that their name and score may appear on public leaderboards.

8.9 If a participant requests data deletion, you must assist LudarisTech in fulfilling that request and delete the data stored locally on your SRT product.

9. Indemnification

9.1 You agree to indemnify and hold LudarisTech harmless from any claims, damages, losses, or expenses (including legal fees) arising from your actions, content, or use of your SRT account.

9.2 While LudarisTech provides usage rules, it is not responsible for user actions or content shared through the SRT platform.

10. Limitation of Liability

10.1 LudarisTech will exercise reasonable skill and care in providing the SRT account but does not guarantee uninterrupted or error-free operation.
10.2 LudarisTech’s total liability shall not exceed the amount paid by you in the preceding 12 months.
10.3 LudarisTech is not liable for indirect, incidental, or consequential damages, including loss of profit or data.

11. General Provisions

11.1 These Terms constitute the entire agreement between you and LudarisTech concerning your SRT account and supersede any prior agreements.
11.2 Failure to enforce a right shall not constitute a waiver.
11.3 You may not assign your rights or obligations under these Terms without LudarisTech’s written consent.
11.4 LudarisTech may assign its rights or obligations in connection with a merger, acquisition, or transfer of assets.
11.5 Nothing in these Terms prevents compliance with applicable law.
11.6 No third party shall have rights under these Terms.
11.7 You agree to comply with all applicable local and international laws when using your SRT account.

12. Governing Law and Dispute Resolution

12.1 These Terms are governed by the laws of Germany.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Memmingen, Germany, without prejudice to LudarisTech’s right to bring action in the user’s local jurisdiction if necessary.

12.2 If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
