Terms & Conditions for Sale

These Terms and Conditions of Sale (“Terms”) govern the sale of products by LudarisTech GmbH & Co. KG, Lilienstraße 10, 86825 Bad Wörishofen, Germany (“LudarisTech”, “we”, “our”, “us”), through the online store available at www.slope-reading-trainer.com.
By placing an order on our website, you agree to be bound by these Terms.

1. Scope and Application

1.1 These Terms apply to all sales of LudarisTech products (“Products”) to both consumers and business customers (B2C and B2B) through our online store.
1.2 Additional or conflicting terms of the buyer do not apply unless explicitly accepted in writing by LudarisTech.
1.3 The use of LudarisTech software or online services (SRT Account, apps, etc.) is governed separately by the Terms and Conditions for Use of Account.

2. Conclusion of Contract

2.1 The presentation of Products in our online shop does not constitute a legally binding offer but an invitation to order.
2.2 By completing the order process and clicking “Buy Now”, you submit a binding offer to purchase.
2.3 The purchase contract is concluded when you receive an order confirmation by email from LudarisTech.

3. Pre-Orders

3.1 Selected Products may be offered for pre-order before their official release.
3.2 By placing a pre-order, you agree to purchase the Product with a delivery date scheduled for February 1, 2026 (or as stated on the product page).
3.3 Pre-orders are charged immediately at checkout.
3.4 If delivery is delayed beyond 30 days from the announced release date, you may cancel your order at any time for a full refund.

4. Prices and Payment

4.1 All prices are shown in euros (€) and include VAT where applicable.
4.2 Payment methods available at checkout include credit card, PayPal, and invoice payment.
4.3 For business customers, valid VAT information must be provided to ensure correct invoicing.
4.4 Full payment is due at the time of order. For pre-orders, the payment confirms your reservation.

5. Shipping and Delivery

5.1 Deliveries are made via DHL.
5.2 LudarisTech currently ships to EU countries, the United Kingdom, and the United States.
5.3 All shipments are made DDP (Delivered Duty Paid) – import duties, taxes, and customs clearance are included in the total price.
5.4 Delivery times are displayed during checkout; for pre-orders, delivery begins from February 1, 2026.
5.5 Risk of accidental loss passes to the buyer upon delivery.

6. Right of Withdrawal (Consumers Only)

6.1 Consumers have the right to withdraw from this contract within 14 days without giving any reason.
6.2 The withdrawal period is 14 days from the day you or a third party named by you received the goods.
6.3 To exercise this right, you must inform us by email at info@slope-reading-trainer.com.
6.4 If you withdraw, we will refund all payments received, including shipping costs, within 14 days after receiving your returned product.
6.5 You must return the goods at your expense and in their original condition.
6.6 The right of withdrawal does not apply to customized or personalized products.

7. Warranty and Liability

7.1 Statutory warranty rights under German law apply. The warranty period for consumers is 24 months from delivery; for business customers, it is 12 months.
7.2 The warranty does not cover normal wear and tear or damage caused by improper use.
7.3 LudarisTech is liable only for direct damages up to the amount of the purchase price. Indirect or consequential damages are excluded unless required by law.

8. Retention of Title

The Product remains the property of LudarisTech until full payment has been received.

9. Limitation of Liability

9.1 LudarisTech is liable for intent and gross negligence.
9.2 For simple negligence, LudarisTech is liable only in cases of breach of essential contractual obligations (“cardinal obligations”), limited to foreseeable damages typical for this type of contract.
9.3 The above limitations do not affect liability under mandatory consumer protection laws.

10. Governing Law and Jurisdiction

10.1 These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 The place of jurisdiction for all disputes is Memmingen, Germany, if the customer is a business or legal entity under public law.
10.3 For consumers, mandatory provisions of their country of residence remain unaffected.

11. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force and effect.
